Acceptable Use Policy

1. Overview

This Acceptable Use Policy governs your use of all Tarkle products including Send, Portal, Crew, and Pentler, as well as all associated services, APIs, and infrastructure operated by Tarkle.

By using any Tarkle product, you agree to this policy. Violations may result in suspension or permanent termination of your account. Resellers and agency account holders are responsible for ensuring their clients and sub-accounts comply with this policy.

2. Prohibited conduct

2.1 Security and system integrity

You must not:

• Probe, scan, or test the vulnerability of any system or network connected to Tarkle without explicit written authorisation.
• Attempt to breach, circumvent, or disable any security measure, authentication system, or access control.
• Access, tamper with, or use non-public areas of the platform.
• Interfere with or disrupt the platform, including by transmitting viruses, malware, or harmful code, or by flooding or overloading any part of the service.
• Introduce any software or mechanism that could impair the performance, availability, or integrity of the platform for any user.

2.2 Unauthorised access and identity

You must not:

• Access or create accounts through automated means other than our publicly supported interfaces.
• Impersonate any person, company, or entity, or misrepresent your affiliation.
• Send altered, deceptive, or false identifying information.
• Sell, transfer, or share your account credentials with any unauthorised person.

2.3 Illegal and harmful content

You must not upload, store, share, or transmit content that:

• Is illegal under any applicable law.
• Constitutes child sexual abuse material or sexualises or exploits minors in any way.
• Contains or promotes extreme violence, terrorist activity, or violent extremist propaganda.
• Incites hatred or discrimination against any person or group based on protected characteristics.
• Infringes the intellectual property, privacy, or other legal rights of any third party.
• Defames, harasses, threatens, or abuses any individual.

2.4 Spam and unsolicited communications

You must not:

• Use Tarkle to send unsolicited commercial messages, spam, or bulk communications to any person who has not consented.
• Use file sharing or workspace invitations as a mechanism for distributing spam or phishing content.

2.5 Payment and commercial abuse

You must not:

• Engage in payment fraud, including unauthorised use of payment methods or illegitimate chargebacks.
• Circumvent or attempt to circumvent storage limits or subscription restrictions.
• Sell, resell, or sublicence access to Tarkle unless operating under an active Send reseller plan in compliance with the White-Label Reseller Terms.

2.6 Platform misuse

You must not:

• Use automated systems, bots, or scripts to interact with the platform in ways that exceed normal user behaviour or circumvent usage limits.
• Use the platform as backend infrastructure to host your own cloud storage or file sharing service for resale outside the scope of the Send reseller plan.
• Use the platform in violation of any applicable export control laws, trade sanctions, or embargo regulations.

3. Contractor management — additional requirements (Crew)

Crew is designed exclusively for legitimate business use in managing independent contractor relationships. The following are additionally prohibited:

• Using the platform to facilitate illegal employment practices or worker misclassification.
• Tax evasion, money laundering, or any other financial crimes.
• Creating fake contractor profiles or fictitious business relationships.
• Managing relationships with contractors you are not legally authorised to hire.
• Operating without required business licences or permits.

You are solely responsible for ensuring your contractor relationships comply with all applicable laws including tax, labour, immigration, and anti-money laundering regulations. Tarkle does not provide legal, tax, or employment advice.

4. Design services — additional requirements (Pentler)

You must not submit briefs that request:

• Content that is illegal, defamatory, or infringes on third-party intellectual property.
• Adult content, hate speech, or content designed to deceive.

You may not resell or white-label the Pentler service without a separate written agreement with Tarkle.

5. Content responsibility

You are solely responsible for all content you upload, store, and share through Tarkle. Tarkle does not review content before it is shared and does not endorse or take responsibility for any user content.

6. Enforcement

Tarkle reserves the right to investigate potential violations and take any of the following actions:

• Remove or disable access to content that violates this policy.
• Issue a warning to the account holder.
• Temporarily suspend access to the account.
• Permanently terminate the account with no refund of any remaining subscription balance.
• Report activity to law enforcement or relevant authorities where required by law.

Repeat violations will result in permanent termination. We do not guarantee prior notice before taking action where immediate action is necessary to protect the platform or other users.

7. Reporting violations

If you come across content or behaviour on Tarkle that appears to violate this policy, we want to know about it. Please report it through our contact page and include as much detail as you can. We review all reports and take appropriate action.

8. Changes to this policy

We may update this policy from time to time. Your continued use of Tarkle after changes take effect constitutes your acceptance of the revised policy.
