These Terms apply to you becoming an Affiliate in the Tarkle Affiliate Program. They explain how the program works and set out the terms and conditions that govern your participation. Throughout these Terms, "we," "us," and "our" refer to Tarkle, and "you," "your," and "yours" refer to you as the Affiliate.
As used in these Terms, "Tarkle" means the applicable entity as defined in our Terms of Service based on your location.
By signing up for the Tarkle Affiliate Program, you agree to be bound by the following terms and conditions.
1. Affiliate rights and obligations
1.1 Registration and affiliate links
To become an Affiliate, you must complete and submit the online registration form, providing your name, a valid email address, and any other information requested. Once approved, you will be assigned a unique affiliate link. You are permitted to place this link on your website, in emails, or in other communications to refer new customers to Tarkle.
To ensure accurate tracking and commission attribution, you must use only the special link formats we provide. Commissions are earned only on sign-ups that occur directly through your properly formatted affiliate link.
1.2 Eligibility
Your platform is not suitable for the Tarkle Affiliate Program if it:
- Promotes illegal activities or content.
- Promotes violence or discrimination based on any protected characteristic.
- Infringes or assists others in infringing any copyright, trademark, or other intellectual property rights.
- Is otherwise unlawful, harmful, threatening, defamatory, obscene, or harassing.
We reserve the right to decline or remove any Affiliate at our sole discretion.
1.3 Representation
You must not design your website, social profile, or any other surface in a way that resembles the Tarkle website or that leads customers to believe you are Tarkle. You are an independent participant in the program. The Tarkle Affiliate Program does not create any partnership, joint venture, franchise, sales representative, or employment relationship between you and Tarkle. You have no authority to make or accept any offers or representations on our behalf.
1.4 Account security
You are responsible for maintaining the security of your affiliate account and credentials. Tarkle is not liable for any loss or damage resulting from your failure to keep your account secure.
1.5 Lawful use
You may not use the Affiliate Program for any illegal or unauthorised purpose. You must comply with all laws applicable in your jurisdiction.
2. Tarkle rights and obligations
2.1 Monitoring
We reserve the right to monitor your website, social profiles, and promotional activity at any time to verify compliance with these Terms.
2.2 Termination for abuse
Tarkle reserves the right to terminate your participation in the Affiliate Program immediately if you abuse the program in any way.
2.3 Tracking limitations
Tarkle is not liable for any failure by you or a referred customer to use the correct affiliate link, or for incorrectly entered affiliate codes. If a referral is not tracked due to such failure, no commission will be owed.
3. Affiliate dashboard
We will provide you with access to an Affiliate Dashboard where you can monitor your referrals, sign-ups, purchases, and commission payments. You will also have access to marketing materials to support your promotional activity.
4. Commissions and payments
4.1 Commission structure
When someone you refer signs up for a paid Tarkle plan through your affiliate link, you earn a commission on their initial payment and on any recurring payments they make for the first 24 months following their first sign-up. The current commission rate is published on the affiliate program page and may be updated from time to time with notice.
For a referral to be eligible, the customer must click through your affiliate link and sign up within 60 days of their first visit. Referrals who return and sign up after the 60-day window are not eligible for commission.
4.2 Payment threshold and timing
Commissions are paid once your balance reaches the minimum payout threshold published on the affiliate program page. You may be required to manually claim your payout and issue an invoice before payment is processed. Payments are made within 45 days of a valid claim.
4.3 Payment method
Commissions are paid via the payment method specified in the affiliate program. You are responsible for any payment processing fees charged by the payment provider.
4.4 Disqualified commissions
We reserve the right to disqualify commissions earned through fraudulent, illegal, or misleading sales or marketing methods. Commissions will only be paid on referrals that are automatically tracked and reported by our systems. We do not pay commissions based on self-reported referrals or manually entered codes that were not tracked.
4.5 Termination for violation
If your participation is terminated due to a violation of these Terms, any unpaid commissions will be forfeited. No refunds are provided for program abuse.
5. Promotion restrictions
5.1 Unsolicited communications
Sending unsolicited commercial emails (spam) to promote Tarkle is strictly prohibited. You may email your existing customers or subscribers, provided they have the option to unsubscribe. You must always clearly represent yourself as independent from Tarkle.
5.2 Trademark bidding
You may not bid on Tarkle-branded keywords — including "tarkle," "tarkle send," "tarkle portal," "tarkle crew," "sharebrand," "bripes," "kontrable," "pentler," "tarkle.com," and any similar variations — in any pay-per-click advertising campaign.
5.3 Prohibited advertising practices
You may not use any online advertising service to promote Tarkle or act on our behalf without prior written approval. Prohibited practices include but are not limited to: overwriting affiliate commission tracking cookies, intercepting searches to redirect traffic, loading Tarkle pages in iFrames, hidden links, and automatic pop-ups that open tarkle.com.
6. Termination and modification
6.1 Termination by either party
Either you or Tarkle may end your participation in the Affiliate Program at any time, with or without cause, by providing written notice.
6.2 Termination for breach
If you fail to comply with these Terms, Tarkle reserves the right to terminate your participation immediately. While we will make reasonable efforts to contact you before taking action, we reserve the right to remove any Affiliate without prior notice on the first occurrence of a serious violation.
6.3 Modifications
We may modify these Terms at any time. We will notify you by email of any material changes. Your continued participation in the Affiliate Program after changes take effect constitutes your acceptance of the revised Terms. If any modification is unacceptable to you, you may terminate your participation at any time.
