DMCA Policy

Tarkle respects the intellectual property rights of others and expects all users of Tarkle products to do the same. In accordance with the Digital Millennium Copyright Act of 1998, we respond to valid notices of alleged copyright infringement reported to our designated agent.

1. Our designated DMCA agent

All DMCA-related notices must be sent to our designated agent. Please do not use this contact for any other purpose.

2. How to submit a notice of alleged infringement

If you believe that content uploaded or shared through a Tarkle product infringes your copyright, you may submit a written notice to our designated agent. To be valid under the DMCA, your notice must include all of the following:

  • Identification of the copyrighted work you believe has been infringed.
  • Identification of the infringing material and information sufficient to locate it on the platform, such as a direct URL.
  • Your contact information, including name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate, and a declaration under penalty of perjury that you are the copyright owner or authorised to act on their behalf.
  • Your physical or electronic signature.

Incomplete notices may not receive a response. Please submit notices through our contact page or by post to the address above.

3. How to submit a counter-notice

If content you uploaded was removed in response to a DMCA notice and you believe the removal was made in error, you may submit a counter-notice. A valid counter-notice must include all of the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of a mistake or misidentification.
  • Your name, mailing address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for your address location, or if outside the United States, the United States District Court for the District of Wyoming.

If we receive a valid counter-notice, we may reinstate the removed material after no less than ten and no more than fourteen business days, unless we receive notice that the complainant has filed a court order.

4. Repeat infringers

Tarkle has a policy of terminating accounts of users who are found to be repeat infringers. A repeat infringer is any account holder who has been the subject of more than one valid DMCA takedown notice that has not been successfully rebutted.

5. Misuse of this process

Filing a DMCA notice with false information is a serious legal matter. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing may be liable for damages. Please only submit notices when you have a genuine, good faith belief that your copyright has been infringed.
